1. DEFINITIONS
« Client(s) » refers to the visitors of the Site  who place an order for their personal use. « Sale Terms » refers to the current sale terms for products sold on Site. « Figaret Paris » stands for Comptoir International De La Chemise, whose headquarters are located on 63 avenue de Villiers, 75017 Paris - France,  owner of the Figaret Paris brand and manufacturer of the products sold on Site. « Parties(s) » refers to either separately or collectively Figaret Paris and/or the Client(s). « Products »  refers to the items sold on Site per article 3 of this document. « Site » refers to the online boutique accessible via the Internet at the following address: www.figaret.com/en on which takes place the sale of Figaret Paris’ products.
2. SCOPE
The current Sale Terms define the conditions applying to the purchase of products by Clients on Site, and the rights and obligations of the Parties associated with such a transaction. This document defines every necessary step to place an order and its follow up between the Parties. When placing an order on Site, the Client declares to have read and accepted the Sale Terms without restriction. This acceptance does not require any signature from the Client. The visit of the Site is also ruled by the Terms of Use. Client declares to have read and accepted the Terms of Use available here without restriction: Terms of use. It is specified that the Client is able to save or print the Sale Terms hereof without modifying them. Figaret Paris reserves its right to update the Sale Terms at any time. The Sale Terms rule all orders placed on Site and supersede any other document, including any other sale terms ruling physical stores or other distribution channels.
3. PRODUCTS
3.1 - Product Description The Products proposed for sale are those displayed on Site at the time of visit within the limits of products’ availability. Figaret Paris  does its best efforts to have the most accurate product description on Site in order to comply with the French consumer laws under Article L.111-1. However, the pictures presenting the Products are only descriptive and do not constitute a contract term, because the colors may vary based on the Client’s computer screen. 3.2 – Product Availability Products are offered for sale within the limits of available stocks. The availability of the products on the website cannot be guaranteed. Should a product become unavailable while an order is being placed, the Client will be informed as soon as possible by e-mail that the order is cancelled or partially cancelled.
4. PRICE
The price of Products, which is displayed in Euros on Site, includes  French VAT, but does not include the price of shipping, which will be displayed during the check-out process. In case the Product(s) is (are) shipped outside of France, the V.A.T. price will update during the check-out process after the country of delivery is chosen. If shipping in the UE, the update will match the V.A.T. of the country chosen. If shipping outside the UE, the VAT will be deducted of the price and the client may have to pay the taxes of its shipping country at time delivery to the delivery personnel. Some potential custom laws may be claimed depending on your country of delivery. In that case, the customer is responsible to pay to the carrier any potential custom laws at delivery. The shipping price is calculated based on the shipping country of Client and the method of shipping (standard or express). The price billed to Client is displayed on it order confirmation sent by e-mail and available on Site. Figaret Paris  reserves the right, accepted by the Client, to modify Product and Shipping prices at any time. These updates shall not modify the costs of orders placed before the change.
5. PROPERTY TRANSFER
Product property is transferred to the Client only after full payment by the Client on the Site.
6. ORDERING PROCESS
6.1 – Site visit: the Client may navigate on the Site to research and check Products without any obligation to buy. 6.2 – Placing an order: it is specified that sales are restricted to the personal use of the Client and should not be related to any business use.  Nevertheless, Figaret Paris does not impose any restriction in the number of orders. 6.3 – Country of  delivery: the Client may place an order on the Site for delivery in one of the available countries listed on Site only. Any other destination country will  be refused and the order cancelled. 6.4 – Final order validation: the Client needs to accept the Sale Terms by checking the box next to “I accept the general sale conditions” before entering payment details and definitely confirming the order. 6.5 – Order confirmation: the  transaction will be considered as final once the Client receives shipment shipment confirmation email. 6.1 – Site visit: the Client may navigate on the Site to research and check Products without any obligation to buy. 6.2 – Placing an order: it is specified that sales are restricted to the personal use of the Client and should not be related to any business use. 7. PAYMENT
The Client shall pay  his/her order after final validation on the Site. The Client shall pay with his/her credit card (Bank Card, Visa,  MasterCard) or  using his PayPal account. Credit card payment requires the entry of card number, expiration date, name of the card holder and visual cryptogram (3 or 4 digits  at the back of the card).  PayPal payment requires login to PayPal account including Client e-mail and password. No payment by check or payment upon delivery will be accepted. Figaret Paris reserves the right to cancel any order in case of dispute with the Client, partial or full payment failure in  previous orders, or bank payment denial . The Client guarantees  that he/she has any necessary authorization to  use the selected payment method  at the time of  order. In the case where the payment method is rejected by the bank 3D-Secure system or  by PayPal, the order will automatically be cancelled. The Client is invited to print the summary of the order. I Information related to the Client’s orders are  saved and stored in Figaret Paris and its bank’s information systems.. These records shall be considered as proof of all transactions between the Parties on the Site.  The orders’ related data archiving takes place on a reliable and lasting support from which they can be generated.
8. DELIVERY
8.1 Delivery modes Products are delivered within a different timeframe according to the Client’s selected shipping  mode during check-out. An exceeded deadline by the logistics partner does not in any way imply that the Client will be entitled to any refund. FRANCE The available delivery modes for France are:
  • - Home delivery (free over 120€ order’s worth):
- Standard delivery (Colissimo) has a maximum delay of 5 days (7 days during holiday season), while express mode (Chronopost) does not exceed 2 days.
  • - In shop delivery (free):
For orders delivered to shops (only in France, Asia boutiques not included), the delivery is express and free, with a delay of 2 to 3 working days. With any order placed before 12pm from Monday to Friday (excluding public holidays), within the limits of stock availability, the Products will be shipped on the same day. The Client will be notified by email once his/her order has arrived in shop, and will dispose of 45 days to pick it up. EUROPE INTERNATIONAL The VAT will be deducted from the price at the time of online payment. Some potential Custom laws may be enforced depending on your country of delivery. In that case, the customer is responsible for paying the carrier any potential Customs and processing fees upon delivery.  The Client is responsible for checking these Customs rules before placing the order. Deliveries to one of the following types of addresses will be denied and cancelled:
  • - Hotel, country club or equivalent type of lodging
  • - Post office delivery
  • - PO box
  • - Non permanent or fixed residence like RV, mobile home, camping site or equivalent type of lodging where an individual address cannot be clearly attributed to a legal or physical person
The Client is responsible for checking the Products’ state upon delivery. Any issue related to the delivery (damaged parcels, missing articles, delivery delays etc.) must be  pointed out to the  carrier’s staff and on the delivery receipt. The Client should also notify it by e-mail to customerservice@figaret.com in a timely manner in order for Figaret Paris to open an enquiry with the shipping partner. If (a) Product(s) is (are) missing, an enquiry with the shipment carrier might take up to 21 working days. In case the Product(s) is (are) found, it(they) will be immediately shipped to the Client at the delivery address of the order. However, if the missing ordered product(s) is (are) not found after 21 days, the Site will ship new ones to the Client. If nothing is notified within 7 days of delivery, the Product(s) will be considered as non-defective and complete and no complaint will be taken into account by the Site.
9. EXCHANGES AND RETURNS
9.1 Exchange terms The Client has the possibility to exchange directly in a shop provided that he/she has placed his/her order with Click&Collect (web-to-store delivery). Exchanging in a shop is not possible for any other delivery modes, and the standard return procedure should be followed. In the specific case of Click&Collect (in-shop) deliveries, the customer may exchange the ordered Product(s) directly in one of Figaret Paris’ boutiques for (a) Product(s) of equivalent price. If the Product(s) is (are) exchanged against a Product(s) of lower price, then the Client will receive store credit corresponding to the price difference between the two. If the Product(s) is (are) exchanged against a Product(s) of higher price, then the Client shall pay the price difference between the two. The Client disposes of 30 days from the day of pick-up from the shop to exchange upon compulsory presentation of the receipt (available online from the Client’s account). In case the Product(s)’ return is decided by Figaret Paris, return fees are born by the Site (refunded according to Colissimo Access’ rate scale). 9.2 Return terms
  1. RIGHT TO CANCEL
Based on article L.121-21-2 of the French Consumer Code, the Client has the right to cancel or partially or fully return  his/her order within 14 days from the day of delivery. The Product(s) must be returned in original condition and original packaging and the Client must follow the return process defined in the return section of the Site. The return shipping costs are at the Client’s expense and, and  no ‘payment upon receipt’ package will be accepted. The associated risks of shipping a return package are also borne by the Client. In agreement with article L.121-20-2 of the French Consumer Code, the right of cancellation is non-applicable in the case of (a) Product(s) specifically designed or highly customized for the Client. If all abovementioned conditions are met, the Site will refund the Client all fees except the return fees. For operational reasons, the refund will be processed within 14 days following the date of reception of the return goods. In case any gift was offered with the purchase, the Client commits himself/herself to returning it with the Product(s). Alternatively, the gift will be charged to the Client. 10. LIMITED RESPONSIBILITY
Figaret Paris  is  only subject to a best-endeavours obligation. The Client remains the sole judge for the appropriateness and fit to its needs and usage of articles ordered. Figaret Paris  cannot be held liable for noncompliant use of products. Figaret Paris  cannot be considered responsible for (i ) loss , alteration or fraudulent personal Customer data access , (ii) the accidental transmission of viruses or other harmful elements resulting from access to the Internet or e-mail transmissions . Figaret Paris  does not warrant that the Site will be available continuously without temporary interruption, suspension or error free. Without limiting the other provisions of the Terms of Sale, Figaret Paris’s  responsibility can be accepted only if a fault is proven attributable exclusively to Figaret Paris. In any case,  its responsibility will be limited to direct damage caused to the Client only. Figaret Paris  reserves the right to suspend the operation of the Site.
11. PERSONAL DATA
In the course of the Client’s use of the Site, he/she may be asked to provide certain information to us. The Client acknowledges and agrees that he/she is  solely responsible for the accuracy and content of such information. The Client agrees that any content, images, video, etc. that he/she submits will not violate the "prohibited uses" section above. If the Client responds to us with any information, including but not limiting to feedback, data, questions, comments, suggestions, or the like, such information shall NOT be deemed confidential. All such submissions shall be deemed Figaret Paris’ property, and his/her submission of information shall constitute an irrevocable royalty-free assignment to Figaret Paris of all worldwide rights, titles and interests in and to such information. Figaret Paris will not be liable for any use or disclosure of such information. Figaret Paris will not have any obligation to keep such information confidential and will be free to reproduce, use, disclose and distribute the information to others without limitation. Figaret Paris will be free to use any ideas, concepts, know-how or techniques contained in such information for any purpose whatsoever, including but not limited to developing, manufacturing and marketing products which incorporate or otherwise rely upon such information. However, our use of any personal information (name, etc.) the Client provides via the Site shall be governed by our Privacy Policy. 12. FORCE MAJEURE
Figaret Paris  cannot be held liable for the total or partial non-performance of its obligations, if such non-performance is due to unforeseeable circumstances or the occurrence of an element of force majeure including,  but not limiting to, flood, fire, storm, lack of raw materials, transport strike, or partial strike or total lockout. These events are a cause for suspension and / or termination of obligations Figaret Paris  towards the Client, without compensations to the Client.
13. INTELLECTUAL PROPERTY
Intellectual property rights of the products sold on the Site are and remain the exclusive property of Figaret Paris. All usage rights are expressly reserved to Figaret Paris. Under these conditions, no one is allowed to reproduce, distribute or use for any purpose whatsoever, even partially, the intellectual property rights without the prior written consent of Figaret Paris. The trademarks and logos are trademarks of Figaret Paris. Any reproduction is therefore an infringement.
14. COOKIES
The Site may place a "cookie" (alphanumeric identifier) in the hard disk of the computer of the Client and for the purpose of easing the Client’s navigation as well as being able to recognize his/her forthcoming consultation on the Site. The Client may oppose the registration of "cookies" on its hard disk by not accepting cookies on its browser. To this end it is recommended to refer to the instruction manual ("help" section of the toolbar of the browser) of its Internet navigation software or to take any useful information from the publisher of said software.
15. SEVERABILITY
If any provision of this Agreement is held to be unenforceable, in whole or in part, such holding will not affect the validity of the other provisions.
16. GOVERNING LAW
These Sale Terms and the contractual relations between the parties are governed by French law. Any dispute arising from the application or interpretation of the Sale Terms is the exclusive jurisdiction of the courts of Paris, France.
